The Tigra Charitable Foundation Online Store Terms of Sale and Conditions

The following terms of sale and conditions apply to all orders for the purchase of products from the Tigra Charitable Foundation's Online Store (the "Tigra Foundation Store"). You agree to be bound by them when placing an order with us.

Please note that all products on the Tigra Foundation Store have been donated to us and all orders are processed by volunteer personnel. We do not have a single paid employee. We do our best to ensure as much of the proceeds of sales go toward our charitable purposes so you can feel great about buying from the Tigra Foundation Store.

The only expenses paid out of the proceeds of the Tigra Foundation Store’s sales are as follows: the cost of paying any Canadian customs clearance charges for items donated by international donors, the cost of shipping products to purchasers, the cost of processing the purchasers' credit cards (Visa/MC transaction processing fees), the cost of hosting this website and related website certificates (such as SSL) and the cost of the paper the purchaser’s receipt is printed on.

Offer and Acceptance. Upon placing an order online or through paper forms to purchase a product from the Tigra Foundation Store we will send you an e-mail confirming the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we ship the product to you by depositing it into the mail system or to a private courier. By placing an order with the Tigra Foundation Store, you represent and warrant that you have the legal capacity and authority to enter into binding contracts.
Description of Products. All products sold at the Tigra Foundation Store have been donated to us and are priced in Canadian dollars. We take reasonable care to ensure that all details, descriptions, physical conditions and prices of products appearing on the Tigra Foundation Store are accurate and up to date, however, we cannot guarantee that information is not out of date or incorrect from time to time or that you will agree with us regarding the physical condition of the product you order. In the event you are not satisfied with your purchase, you have a right to a cancellation or refund subject to the terms below.
Availability. The supply of products from the Tigra Foundation Store is subject to availability and it is not always possible for us to inform you at the time you place your order whether the products you want are still available for purchase. Accordingly, we may contact you after you place your order to update you about the availability of your selected products. We do not bill your credit card until your order is ready to ship even if you have entered your credit card details online.
Special Purchase Conditions. Certain products and orders through the Tigra Foundation Store have special purchase conditions attached to them. For example, certain high value purchases will require completion of paper forms, signature, shipping address, credit card and government issued ID verification protocols and will not be shipped unless we are satisfied the purchaser is making a legitimate purchase that is authorized by the credit card holder. Our personnel will contact the purchaser in such cases to expedite the completion of the due diligence information and shipping of the order.
Delivery. The estimated cost of shipping a particular product within Canada is posted on the Tigra Foundation Store for each product, except for designated special shipping products, which are discussed further below. If a purchaser is ordering multiple products, we will bill the purchaser the higher of the posted shipping cost of all of the products and not the sum total of the posted shipping cost of each product.

In rare cases prior to shipping, we may contact the purchaser to advise that the estimated shipping cost does not cover the actual cost of shipping and will request the purchaser to authorize us to bill the difference.

Some products are considered special shipping products because of their size, weight or value. These products may not have a shipping cost posted on the Tigra Foundation Store. The cost of shipping such items will depend on their size/weight, the destination, shipping method, whether insurance needs to be purchased and certain other factors. Purchasers may email us to get a shipping cost estimate for such products or place their order and one of our personnel will contact the purchaser with the cost of shipping.

For orders shipping to destinations outside of Canada, we will quote shipping costs upon request. Please email us.

We endeavor to ship orders within five business days of the payment being processed but in rare case it may take longer.
International Orders. Orders that are shipped to destinations other than Canada may be subject to custom duties, customs clearance costs and the destination country’s taxes. These are not included in the purchase price or shipping cost. The Purchaser is responsible for these charges and we have no control over them and cannot predict what they may be. Customs policies vary widely from country to country. If you would like any further information, you should contact your local customs office.

To place an order to a shipping destination other than Canada or the USA, please complete our paper order forms as we do not offer international options in our online shopping cart or check out process.
Refunds and Returns. Orders may be cancelled prior to shipping for a full refund of the purchase price and shipping cost. Products that have been shipped may be returned within 14 days of the receipt of the products for a refund of the purchase price, provided that, the products returned are in the same condition they were shipped in. Unfortunately, we are unable to refund the shipping costs charged by the Tigra Foundation Store for products that have been shipped to the purchaser. We also do not refund the purchaser’s cost of shipping the returned product to us.

Purchase price refunds of products returned in the same condition they were shipped in will be processed within 14 days of receipt of the returned products.
Consent to Use Personal Information. By submitting an order to the Tigra Foundation Store, you are expressly permitting us to use your personal information to process your order and store your information in our databases. Limitation of Liability. Our liability is limited to the purchase price of the products ordered and the shipping cost paid by a purchaser regardless of the circumstances or however sustained, including but not limited to injury, loss or damage sustained directly or indirectly as a result of the use of this website to view or purchase items, the disclosure or use of personal information to or by the Tigra Charitable Foundation or the use of items purchased from the Tigra Foundation Store.
Changes to These Terms of Sale and Conditions. We reserve the right to make changes to our website, policies, and these Terms of Sale and Conditions at any time. You will be subject to the policies and Terms of Sale and Conditions in force at the time that you place an order with us. If any of these conditions are deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining Terms and Conditions of Sale.
Governing Law and Venue. All orders and these Terms of Sale and Conditions shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada. We and you agree to submit to the exclusive jurisdiction of the courts located in Vancouver, British Columbia. No action or proceeding may be brought in any other court or forum.
